Abstract

Penelitian ini dilatarbelakangi adanya peran kepolisian Polres Kotawaringin Barat dalam menawarkan penerapan restorative justice dalam tindak pidana ringan. Dimana hal ini sesuai dengan Peraturan Kepolisian Negara Republik Indonesia Nomor 8 Tahun 2021 Pasal 14 ayat (1) yang mengudang pihak-pihak yang berkonflik,memfasilitasi atau memediasi antar pihak. Dalam pelaksanaannya belum sepenuhnya dilaksanakan dan belum optimal penerapan restorative justice adalah kurang aktifnya pihak yang berwenang dalam meningkatkan pemahaman kepada pihak yang berperkara. Adapun penelitian yang penulis lakukan termasuk penelitian yuridis empiris. Pendekatan yang digunakan penulis adalah pendekatan socio-legal,, metode pengumpulan data yang digunakan adalah metode observasi, wawancara dan dokumentasi. Hasil penelitian yakni proses pemyelesaian tindak pidana ringan di Polres Kotawaringin Barat sesuai dengan dasar hukum dan ketentuannya terpenuhinya yakni persyaratan formil dan materil, perdamaian dari kedua belah pihak yakni pelapor maka, akan dilaksankan surat pernyataan perdamaian yang di fasilitasi oleh pihak kepolisian penyelesaian melalui restorative justice. Efektivitas implementasi dalam penerapan restorative justice dalam kasus pencurian ringan, masih belum bisa sepenuhnya terlaksana karena ketidak kesepakatan damai dari pelaku dan korban dan kurang optimalnya kepolisian dalam menekan kasus perdamaian. Hal ini tidak selaras dengan peraturan yang telah di jelaskan dalam Peraturan Kepolisian Nomor 8 Tahun 2021 tentang Penanganan tindak pidana berdasarkan keadilan restoratif. Di harapkan kepolisian lebih optimal dalam menerapkan restorative justice di jenis perkara pencurian ringan hal tersebut dilihat dari faktor kasus perkasus.

ABSTRACT

This research is motivated by the passivity and inconsistency of investigators in offering the application of restorative justice in minor crimes. Where this is not in accordance with the Regulation of the Indonesian National Police Number 8 of 2021 Article 14 paragraph (1) which invites conflicting parties, facilitates or mediates between parties. In its implementation, it has not been fully implemented and the application of restorative justice has not been optimal due to the lack of activeness of the competent authorities in increasing understanding of the litigants. This research includes field research (empirical) with the type of sociological juridical research. The research method used in data collection is the method of observation, interviews and documentation. The result study in this is the role of the West Kotawaringin Police Police who are authorized and carry out the circular letter of the National Police Chief in implementing restorative justice in the settlement process, the effectiveness of implementation in the application of restorative justice in cases of minor theft, still cannot be fully implemented due to the lack of a peace agreement from the perpetrators and victims and the lack of optimal investigator skills in their performance. This is not in line with the regulations described in Police Regulation Number 8 of 2021 concerning Handling of criminal acts based on restorative justice. investigators have not been optimal in implementing restorative justice in this type of light theft case, this can be seen from case-by-case factors.
