Abstract

Penelitian ini dilatarbelakangi oleh lahirnya Peraturan yang dikeluarkan oleh Pemerintah Kota Palangka Raya dalam menanggulangi penyebaran wabah virus COVID-19, yaitu Peraturan Walikota Palangka Raya Nomor 26 Tahun 2020 tentang Penerapan Disiplin dan penegakan hukum Protokol Kesehatan dalam rangka percepatan penanganan COVID-19 dan pemulihan ekonomi Kota Palangka Raya. Fokus masalah pada pembahasan ini ada 3 yaitu latar belakang lahirnya peraturan, kedudukan dan kekuatan hukum peraturan Walikota Palangka Raya Nomor 26 Tahun 2020. Jenis penelitian ini adalah penelitian hukum normatif dengan pendekatan perundang-undangan. teori yang peneliti gunakan adalah teori kebijakan publik, teori pembentukan peraturan perundang-undangan, teori hierarki peraturan perundang-undangan, dan teori otonomi daerah teori diatas digunakan untuk menganalisa peraturan perundang-undangan yang ada. Berdasarkan hasil penelitian dapat dipahami materi muatan Peraturan Walikota Palangka Raya Nomor 26 Tahun 2020 dapat diterbitkan bukan berdasarkan amanat perda kabupaten/kota, tetapi berdasarkan kewenangan yang dimiliki. Walikota Palangka Raya sebagai kepala daerah di tingkat Kota Palangka Raya dan berdasarkan instruksi Presiden nomor 7 tahun 2020, instruksi Menteri Dalam Negeri Nomor 4 Tahun 2020. Berdasarkan pasal 8 ayat (2) Undang-Undang Nomor 12 Tahun 2011, adalah diakui keberadaannya dan mengikat sepanjang diperintahkan oleh peraturan perundang-undangan yang lebih tinggi atau berdasarkan kewenangannya.

ABSTRACT

This research was motivated by the birth of a regulation issued by the Palangka Raya City Government in tackling the spread of the COVID-19 virus outbreak, namely Palangka Raya Mayor Regulation Number 26 of 2020 concerning the application of discipline and law enforcement of Health Protocols in the context of accelerating the handling of COVID-19 and the city's economic recovery. Palangka Raya. There are 3 focus problems in this discussion, namely the background of the birth of regulations, the position and legal force of the Palangka Raya Mayor Regulation Number 26 of 2020. This type of research is normative legal research with a statutory approach. The theory that the researcher uses is the theory of public policy, the theory of the formation of laws and regulations, the theory of the hierarchy of laws and regulations, and the theory of regional autonomy. The theory above is used to analyze the existing laws and regulations. Based on the results of the study, it can be understood that the content of the Palangka Raya Mayor Regulation Number 26 of 2020 can be issued not based on the mandate of the regency/city regulations, but based on the authority. of the Palangka Raya Mayor as regional head at the Palangka Raya City level and based on the Presidential instruction number 7 of 2020, Instruction of the Minister of Home Affairs Number 4 of 2020. Based on article 8 paragraph (2) of Law Number 12 of 2011, its existence is recognized and binding as long as it is ordered by a higher statutory regulation or based on its authority.
