Abstract

Penelitian ini dilatarbelakangi oleh adanya kegiatan praktik utang piutang tanah yang didasari atas rasa saling percaya tanpa adanya surat perjanjian ataupun tanda terima sehingga menimbulkan suatu permasalahan antara kedua belah pihak. Penelitian ini difokuskan pada praktik utang tanah perkebunan, penyelesaian utang tanah perkebunan dengan denda adat singer dan singer menurut perspektif Hukum Ekonomi Syariah. Penelitian ini termasuk ke dalam penelitian empris yang mengkaji ketentuan hukum yang berlaku serta apa yang terjadi dalam kenyataan masyarakat. Dikaji melalui pendekatan kualitatif (socio-legal) yang dianalisis melalui teori hukum perjanjian, teori wanprestasi, teori penyelesaian sengketa dan teori mediasi. Adapun hasil penelitian ini adalah : (1) Praktik Utang Tanah Perkebunan di Desa Tewang Sanggalang Garing terjadi berdasarkan rasa saling percaya antar kedua belah pihak tanpa adanya surat perjanjian dan dibayar belakangan sehingga menyebabkan terjadinya wanprestasi. (2) Penyelesaian Masalah Utang Tanah Perkebunan di Desa Tewang Sanggalang Garing menggunakan proses Peradilan Adat tetapi sebelum itu harus ada proses mediasi terlebih dimana kedua belah pihak dipertemukan apabila tidak ada jalan keluar dari masalah tersebut baru dilaksanakan Peradilan Adat. (3) Singer Menurut Perspektif Hukum Ekonomi Syariah tidak menyalahi hukum Islam karena denda dimaksudkan untuk memberikan hukuman dan efek jera kepada orang yang memberikan kerugian terhadap orang lain.

ABSTRACT

This research is motivated by the practical activities of debts ground based on mutual trust in the absence of a letter of agreement or receipt so that poses a problem between the two sides. This study focused on the practices of the debt of plantation land, the settlement of debts of plantation land with a fine traditional singer and singer according to the Legal perspective of Islamic Economics. This study includes research into the empris that examines the provisions of the applicable law as well as what happens in the reality of society. Examined through a qualitative approach (socio-legal) that were analyzed through the theory of the law of treaties, the theory of tort, the theory of the settlement of the dispute and the theory of mediation. The results of this study are : (1) the Practice of Debt of Plantation Land in the Village, Tewang Sanggalang Garing occur based on mutual trust between the two parties in the absence of the letter of agreement and pay later, causing the occurrence of default. (2) the Settlement of the Debt Problems of Plantation Land in the Village, Tewang Sanggalang Garing using the process of Customary Justice but before that there must be a process of mediation the first in which the two parties met if there is no way out of these problems recently implemented the Customary Justice. (3) Singer According to the Perspective of the Law of Islamic Economics does not violate Islamic law due to the fine intended to give you a punishment and a deterrent effect to those who give a disadvantage against others.
