Abstract

Penelitian ini di latar belakangi dengan adanya kasus wanprestasi dalam jual beli dengan pembayaran melalui shopee pay later pada konsumen yang berada di Kota Palangka raya dengan pihak shopee. Penelitian ini berfokuskan pada: 1). Bagaimana kronologi kasus wanprestasi dalam jual beli melalui shopee pay later di Kota Palangka Raya; 2). Bagaimana mekanisme refund dalam jual beli dengan pembayaran melalui shopee pay later; 3). Bagaimana tanggung jawab pihak penjual dan pihak shopee terhadap wanprestasi. Jenis penelitian yang digunakan adalah yuridis empiris dengan pendekatan sosiologi hukum. Data penelitian dihimpun melalui wawancara dan dokumentasi.

Subjek penelitian ini adalah 3 orang meliputi konsumen, penjual, dan admin shopee. Hasil penelitian menunjukan bahwa 1). Pada kasus yang ada di Kota Palangka Raya terjadi suatu wanprestasi dalam jual beli oleh pihak penjual kepada pihak pembeli; 2). Mekanisme refund dalam jual beli dengan pembayaran melalui shopee pay later dalam kebijakannya sama dengan mekanismen refund pada aplikasi shopee pada umumnya; 3). Pada penyelesaian wanprestasi bahwa dari pihak penjual tidak melakukan tanggungjawabnya, dan dari pihak shopee telah menjalankan tanggungjawabnya selaku penyedia platform, serta dari pihak shopee pay later pun mengikuti keputusan dari pihak shopee. Sehinggal transaksi tersebut tetap berjalan sebagai mana mestinya, pihak shopee menganggap tidak ada pembatalan dalam transaksi dikarenakan pihak pembeli tidak mengirimkan barang yang telah diterima ke tim shopee.

ABSTRACT

This research is motivated by a case of default in buying and selling with payments through shopee pay later on consumers who are in the city of Palangka Raya with shopee parties. This research focuses on: 1). What is the chronology of cases of default in buying and selling through shopee pay later in Palangka Raya City; 2). How is the refund mechanism in buying and selling with payment through shopee pay later; 3). What is the responsibility of the seller and the shopee against default. The type of research used is empirical juridical with a legal sociology approach. Research data were collected through interviews and documentation.

The subjects of this study were 3 people including consumers, sellers, and shopee admins. The results showed that 1). In the case in Palangka Raya City there was a default in the sale and purchase by the seller to the buyer; 2). The refund mechanism in buying and selling with payment through shopee pay later in its policy is the same as the refund mechanism in shopee applications in general; 3). In the settlement of the default, that the seller does not carry out his responsibilities, and the shopee has carried out his responsibilities as a platform provider, and from the shopee pay later party also follows the decision from the shopee. So that the transaction continues as it should, the shopee assumes there is no cancellation in the transaction because the buyer does not send the goods that have been received to the shopee team.
