Abstract

The main problem in this study is the analysis of the impact of the policy of the Minister of Transportation Regulation Number 118 of 2018 concerning Special Lease Transportation to Article 27 paragraph (2) of the 1945 Constitution from the Fiqh Siyasah Perspective”. The results of the study show that first: the regulation of the Minister of Transportation Number 118 of 2018 concerning Special Rental Transportation which regulates online taxis has been changed several times but still harms conventional transportation (public transportation), there is leeway for online transportation in terms of operating permits, vehicle plate color , where to pick up passengers, and fares are aspects that are the main points of conflict between conventional transportation and online transportation, thus making this online transportation a
monopoly on transportation fares. Article 27 paragraph (2) of the 1945 Constitution states that every Indonesian citizen has the right to work and a decent living for humanity where technological developments cannot be limited because along with the development of the era of technology also continues to develop, especially in the field of transportation, the existence of online transportation. also has positive and negative impacts on the community. Second: according to fiqh siyasah, the policy of the Minister of Transportation Regulation Number 118 of 2018 has not met the criteria in the formation of laws and regulations in siyasa dusturiyah, because of the inequality caused by regulations on conventional transportation ( public transportation) thus triggering unfair competition in the transportation sector
