Abstract

Penelitian ini dilatar belakangi oleh pemilik jasa reparasi barang elektronik yang membuat perjanjian secara sepihak tanpa memberitahukan kepada konsumen terlebih dahulu. Fokus penelitian ini adalah (1) Bagaimana isi nota perjanjian jasa reparasi barang elektronik yang diabaikan pemiliknya?. (2) Mengapa barang elektronik yang diabaikan pemiliknya dijual oleh jasa reparasi barang elektronik?.

Subjek penelitian ini adalah pemilik usaha dan pembeli dari Harianto Servis, Lamandau All servis, Ridho Electronic Service. Data penelitian dihimpun dengan metode observasi, wawancara dan dokumentasi, dianalisis secara deskriptif kualitatif. Hasil penelitian ini menunjukan bahwa: (1) Isi nota perjanjian yang dibuat pemilik jasa raparasi barang elektronik terdapat klausula baku yang dilarang Undang-undang perlindungan konsumen karena memuat syarat eksonerasi. (2) Alasan pemilik jasa reparasi barang elektronik menjual barang yang diabaikan pemiliknya karena pemilik jasa mendapatkan kerugian yaitu, kerugian modal atau biaya dan kerugian waktu karena harus memperbaiki barang tersebut.

ABSTRACT

This research is motivated by the owner of electronic goods repair service who made the agreement unilaterally without notifying consumers in advance. The focus of this study is (1) How is the contents of the electronic goods repair service agreement that the owner ignored?. (2) Why are electronic goods ignored by their owners sold by electronic goods repair services?.

The subjects of this study were business owners and buyers of Harianto Servis, Lamandau All servis, Ridho Electronic Service. The research data was collected by observation methods, interviews and documentation, analyzed descriptively qualitatively. The results of this study show that: (1) The contents of the memorandum of agreement made by the owner of the electronic goods repair service there is a standard clause that is prohibited by the Consumer Protection Act because it contains the terms of the exonration. (2) The reason the owner of electronic goods repair services sells goods that the owner ignores because the service owner gets losses, namely, capital losses or costs and time losses due to having to repair the goods.
