Abstract
Latar belakang penelitian ini adalah terletak di Kecamatan mentaya Hilir Utara masih adanya BUMDes yang tidak sesuai dengan prinsip mas’uliyah padahal pengurus rata-rata beragama Islam. Kecamatan Mentaya Hilir Utara terdapat 7 (tujuh) Desa dan disetiap Desa sudah dibentuk BUMDes namun dari ketujuh BUMDes tersebut hanya terdapat 4 (empat) yang berjalan sedangkan 3 (tiga) BUMDes tidak berjalan, BUMDes dibentuk dengan menggunakan dana Desa. Namun yang menjadi objek dari penelitian ini hanya 3 (tiga) BUMDes yaitu: BUMDes Barokah Jaya, BUMDes Cahaya Mandiri, dan BUMDes Berkat Bersama. Fokus penelitian ini adalah prinsip mas’uliyah dalam kepengurusan Badan Usaha Milik Desa di Kecamatan Mentaya Hilir Utara. Adapun rumusan masalah dari penelitian ini. (1) Bagaimana pelaksanaan program BUMDes di Kecamatan Mentaya Hilir Utara? (2) Bagaimana prinsip mas’uliyah dalam kepengurusan BUMDes di Kecamatan Mentaya Hilir Utara? Jenis penelitian ini adalah yuridis empiris dengan pendekatan kualitatif deskriftif. Subjek penelitian ini adalah pengurus BUMDes, Kepala Desa, dan Masyarakat pengguna jasa BUMDes yang didasarkan pada teori manajemen, teori tanggung jawab, dan teori maqashid syari’ah. Data penelitian di himpun dengan cara observasi dan wawancara. Hasil penelitian ini : (1) Dalam pelaksanaan program BUMDes tidak berjalan seluruhnya dan kurangnya sosialisasi kepada masyarakat mengenai program BUMDes atau didapat diartikan teknik marketing yang kurang kompeten dan efisien. (2) Semua pengurus memahami prinsip mas’uliyah atau tanggung jawab namun dalam praktik nya tidak semua melaksanakan prinsip tersebut.
ABSTRACT
The background of this research is located in North Mentaya Hilir District, there are still BUMDes that are not in accordance with the mas'uliyah principle even though the administrators are mostly Muslim. Villages in Mentaya Hilir Utara District there are 7 (seven) villages and in each village has been formed BUMDes but of the seven BUMDes there are only 4 (four) running while 3 (three) BUMDes do not run BUMDes formed using village funds. However, the object of this study is only 3 (three) BUMDes are: BUMDes Barokah Jaya, BUMDes Cahaya Mandiri, and BUMDes Berkat Bersama. The focus of this research is the principle of mas'uliyah in the management of Village Owned Enterprises in Mentaya Hilir Utara District. As for the problem formulation of this research. (1) How is the implementation of bumdes program in North Downstream Mentaya Subdistrict? (2) What is the principle of mas'uliyah in the management of BUMDes in Mentaya Hilir Utara District? This type of research is empirical juridical with a qualitatively de-de-decryive approach. The subjects of this study are bumdes administrators, village heads, and community users of BUMDes services based on management theory, responsibility theory, and shari'ah maqashidtheory. Research data is collected by way of observation and interview. The results of this study: (1) In the implementation of bumdes program does not run entirely and the lack of socialization to the community about bumdes program or obtained is interpreted as less competent and efficient marketing techniques. (2) All administrators understand the principle of mas'uliyah or responsibility but in practice not all carry out the principle.
