Abstract
Bank Syariah Indonesia Kantor Cabang Palangka Raya 3 memberikan fasilitas kartu ATM untuk mempermudah nasabah melakukan penarikan tunai beserta transaksi lainnya yang dapat diakses pada mesin-mesin ATM. Untuk memperoleh kartu ATM nasabah harus menandatangani perjanjian pembuatan kartu ATM. Dalam perjanjian tersebut terdapat klausula yang menyatakan pengalihan tanggungjawab bank atas segala kerugian nasabah yang timbul akibat pemalsuan kartu, kerusakan dan atau kegagalan bekerjanya mesin ATM dan atau sarana lain yang disebabkan oleh hal-hal diluar kekuasaan bank. Maka dari itu penulis merangkul rumusan masalah sebagai berikut (1) Bagaimana tindakan bank dalam melindungi data nasabah di BSI Kantor Cabang Palangka Raya 3? (2) Bagaimana strategi perbankan dalam melindungi data nasabah menurut aspek ekonomi syariah? Tujuan penelitian ini adalah untuk mengetahui mengenai strategi bank syariah terkait pencurian data kartu magnetic nasabah ditinjau dari perlindungan data nasabah di bank BSI Kantor Cabang Palangka Raya 3.
Metode penelitian ini menggunakan pendekatan kualitatif deskriptif. Pengumpulan data dilakukan dengan menggunakan teknik wawancara, observasi dan dokumentasi. Adapun teknik penentuan subjek pada penelitian ini menggunakan teknik purposive sampling yaitu teknik penentuan subjek berdasarkan beberapa pertimbangan antara lain adalah karyawan BSI Kantor Cabang Palangka Raya 3 yang terdiri dari Branch Operation and Service Manager, Mikro staf, Customer Service Representative dan Teller. Pengabsahan data dilakukan dengan menggunakan triangulasi. Selanjutnya data diolah dan dianalisis dengan beberapa tahapan yaitu: pengumpulan data/reduksi data, penyajian data, conclusions (penarikan kesimpulan dengan melihat penyajian data), dan Verifikasi (penarikan kesimpulan untuk menjawab dari rumusan masalah).
Hasil dari penelitian ini menunjukan bahwa Tindakan strategi Bank Syariah Indonesia Kantor Cabang Palangka Raya 3 dalam melindungi data nasabah yaitu: 1) mengedukasi nasabah, 2) menjaga kerahasiaan data nasabah, 3) meningkatkan sistem keamanan pada mesin ATM. Sedangkan Strategi pihak bank dalam melindungi data pribadi nasabah berdasarkan aspek ekonomi syariah yaitu berdasarkan asas amanah dan asas keadilan.
ABSTRACT
Bank Syariah Indonesia Palangka Raya Branch Office 3 provide ATM card facilities to make it easer for customers to make cash withdrawals and other transaction that can be accessed at ATM machines. To obtain an ATM card customers must sign an agreement creating an ATM card. Under these agreements have clauses stating the transfer of responsibility for customers bank for any losses incurred due to card fraud, damage and or failure of the workings of ATM machines and / or other facilities caused by things beyond the power of the bank. Therefore the author embraces the following problem formulation (1) What are the actions of banks in protecting customer data at BSI Palangka Raya Branch Office 3? (2) What is the banking strategy in protecting customer data according to the Islamic economic aspect? The purpose of this study was to determine the strategy of Islamic banks related to the theft of customer magnetic card data in terms of customer data protection at the BSI Palangka Raya Branch Office 3.
This research method uses a descriptive qualitative approach. Data collected was carried out using interview, observation and documentation techniques. The technique of determining the subject in this study uses purposive sampling technique, namely the technique of determining the subject based on several considerations, including the employees of BSI Palangka Raya Branch Office 3 which consists of Branch Operations and Service Managers, Marketing Managers, Customer Service Representatives and Tellers. Data Validation is done by using triangulation. Furthermore, the data is processed and analyzed with several stages, namely: data collection / data reduction, data presentation, conclusions (drawing conclusions by looking at the data presentation), and Verification (drawing conclusions to answer the problem formulation).
The results of this study indicate that the strategic actions of Bank Syariah Indonesia Palangka Raya Branch Office 3 in protecting customer data are: 1) educating customers, 2) maintaining the confidentiality of customer data, 3) improving security systems on ATM machines. Meanwhile, the strategy of the bank in protecting customer's personal data is based on the sharia economic aspect, namely based on the principle of trust and the principle of justice.
