Abstract

RSUD dr. Doris Sylvanus merupakan salah satu fasilitas kesehatan yang ada di Palangka Raya, dimana lokasi tersebut disediakan tempat parkir yang diperuntukkan untuk pengunjung. Di area parkir RSUD dr. Doris Sylvanus Palangka Raya melakukan penerapan tarif parkir dengan sistem per jam setelah empat jam pertama. Berdasarkan latar belakang di atas, maka permasalahannya adalah bagaimana tinjauan hukum Islam terhadap pelaksanaan sistem parkir per jam di RSUD dr. Doris Sylvanus Palangka Raya. Dalam hal ini, penelitian ini bertujuan untuk mengetahui apakah pelaksanaan sistem parkir per jam seperti ini diperbolehkan atau tidak dalam Islam.

Metode penelitian yang digunakan dalam penelitian ini adalah normative empiris yang menggunakan pendekatan deskriptif kualitatif dengan tahapan analisis: penyaringan data, penyajian data, kesimpullan data serta analisis.

Berdasarkan hasil penelitian penulis bahwa penyebab diberlakukan sistem parkir per jam di RSUD dr. Doris Sylvanus karena sistem dan tarif yang ditentukan oleh management PT. Panca Artha Abadi dengan sistem tarif per jam dan pelaksaannya berdasarkan Keputusan Direktur no 6287 tahun 2017. Setelah ditinjau dari hukum Islam, akad yang dilakukan antara pengguna dan penyedia jasa termasuk dalam akad yang disebut akad ijarah dan hukumnya adalah mubah atau boleh, karena adanya biaya operasional yang harus ditanggung oleh perusahaan.

Abstarct

Regional General Hospital dr. Doris Sylvanus is one of the health facilities in Palangka Raya, where the location provides a parking lot for visitors. In the parking are of Regional General Hospital dr. Doris Sylvanus Palangka Raya applies parking rates on an hourly basis after the first four hours. Based on the background above, the problem was how to review Islamic law in the implementation of the hourly parking system at Regional General Hospital dr. Doris Sylvanus Palangka Raya. In this case, this study aims to find out whether the implementation of an hourly parking system they have is permissible or not in Islam.

The research method used in this study was an empirical normative that used a qualitative descriptive approach to the stages of analysis: data filtering, data presenting, data conclusions and analysis.

Based on the results of the author's research that the cause it was enforced the hourly parking system in at Regional General Hospital dr. Doris Sylvanus because the system and the rate determined by the management of PT. Panca Artha Abadi with an hourly rate system and its implementation based in Director Decree no. 6287 in 2017. After reviewing from Islamic law, the contact between the user and the service provider is included in the contract called the ijarah contract and the law is mubah or permissible, due to operational costs that must be borne by the company.
