Abstract

Penelitian ini dilatarbelakangi adanya praktik transaksi bill hotel yang lazim dilakukan ASN dengan alasan pembuktian pada lembar pertanggung jawaban perjalanan dinas. Fokus penelitian ini adalah mengkaji transaksi bill hotel dan mengemukakan pandangan Ulama kota Palangka Raya terhadap praktik tersebut. Adapun rumusan masalahnya adalah (1) Bagaimana praktik transaksi bill hotel di kota Palangka Raya? (2) Mengapa terjadi praktik transaksi bill hotel di kota Palangka Raya? (3) Bagaimana pandangan Ulama kota Palangka Raya terhadap transaksi bill hotel?

Penelitian empiris dalam hukum Islam ini menggunakan pendekatan konseptual, pendekatan uṣhūl fiqh dan pendekatan fiqh. Objeknya adalah transaksi bill hotel dan pandangan Ulama kota Palangka Raya terkait transaksi bill hotel yang didasarkan pada sumber hukum Islam dan metode istinbāṭ hukum. Data penelitian dihimpun dengan metode observasi, wawancara dan dokumentasi.

Hasil penelitian ini: (1) Praktik transaksi bill hotel dilakukan dengan dua cara yaitu: pertama ASN langsung membeli bill hotel tanpa menginap di hotel. kedua ASN menginap terlebih dahulu di hotel, kemudian pada saat check out harga kamar dimark up, atau pada saat check out membeli bill hotel tambahan. (2) Transaksi bill hotel dilakukan untuk memenuhi laporan bukti perjalanan dinas atau laporan hasil kegiatan ASN. (3) Pandangan Ulama kota Palangka Raya menyatakan transaksi bill hotel yang mengandung rekayasa atau tipuan adalah haram. Namun dalam suatu kasus (dua) Ulama memperbolehkan transaksi tersebut karena adanya unsur kemaslahatan. Adapun terkait akad praktik transaksi ini yaitu: 1 (satu) Ulama menyebutkan transaksi ini merupakan jual beli. Sedangkan 2 (dua) Ulama lain menyebutkan transaksi ini merupakan jual beli dan ijarah, adapun 2 (dua) Ulama yang berbeda menyebutkan transaksi tersebut batil/ transaksi tidak halal.

ABSTRACT

This research has been motivated by the practice of hotel bill transactions that were commonly carried out by ASN on the grounds of proof on the official travel responsibility sheet. The focus of this study was to examine hotel bill transactions and express the views of the Ulama city of Palangka Raya to the practice. The formulation of the problem are (1) how does the practice of hotel bill transactions in the city of Palangka Raya? (2) Why does the practice of hotel bill transactions occur in the city of Palangka Raya? (3) What is the view of the Ulama city of Palangka Raya on hotel bill transactions?

The empirical research in Islamic law used a conceptual approach, the uṣhūl fiqh approach, and the fiqh approach. The object is the hotel bill transaction and the view of the Ulama in Palangka Raya city related to hotel bill transactions which are based on Islamic legal sources and istinbāṭ legal methods. Research data collected by observation, interview, and documentation methods.

The results of this study: (1) The practice of hotel bill transactions are done in two ways: first, the customer is directly buying a hotel bill without staying at the hotel. Secondly, the customer stays at the hotel, and then when checking out the price of the room is marked up, or when checking out buy additional hotel bills. (2) Hotel bill transactions are conducted because they are to fulfill the official travel evidence report or Civil Servant activity report. (3) The view of the Ulamas of Palangka Raya city-states that a hotel bill transaction containing engineering or deception is unlawful or haram, but there is one case in the transaction that is allowed by 2 (two) Ulamas to be carried out because there is an element of maṣlaḥah. Regarding the contract of practice for this transaction: 1 (one) Ulama stated the transaction was a sale and purchase. However 2 (two) Ulamas stated the transaction was a sale and purchase and ijarah, and 2 (two) Ulamas called that is an invalid transaction / non-halal transaction.
