Abstract

Penelitian ini dilatar belakangi banyaknya mahasiswa yang melakukan pernikahan pada masa studi, yang tentunya berdampak pada studinya. Fokus penelitian ini adalah : 1) Apa Motivasi Mahasiswa IAIN Palangka Raya menikah pada masa studi?, 2)Bagaimana Pandangan Maqa>s}id Asy-syari>’ah terhadap pernikahan pada masa studi bagi mahasiswa IAIN Palangka Raya?. Penelitian empiris ini menggunakan pendekatan hukum Islam dan sosiologi. Subjek penilitian ini memiliki dua kategori, yaitu mahasiswa alumni dan mahasiswa aktif dengan ketentuan sudah melakukan pernikahan. Subjek penelitian berjumlah 8 (orang) dan 2 (dua) Informan. Data dianalisis melalui observasi, wawancara, dan dokumentasi. yang dianalisis melalui teori hukum Islam Maqa>s}id Asy-syari>’ah, teori aksi dan teori motivasi. Hasil penelitian ini adalah: 1) Motivasi mahasiswa menikah pada masa studi untuk menghindari zina, merasa cocok dengan pasangannya dan saling membutuhkan serta dukungan dari keluarga untuk membantu perekonomian. 2) Pandangan Maqa>s}id Asy-syari>’ah ( hifz} al-Din, hifz} nafs, hifz} al-nasab, hifz} al-aql dan hifz} al-mal) terhadap menikah pada masa studi mahasiswa IAIN Palangka Raya mengandung kemaslahatan dan juga mengandung kemudharatan yang terjadi dalam pernikahan mereka. Tetapi jika dilihat dari tugas utama mereka sebagai mahasiswa sebenarnya, menikah pada masa studi lebih besar kemudharatan dari pada kemaslahatan.

ABSTRACT

This research was motivated by the large number of students who married during their studies, which of course had an impact on their studies. The focus of this research is: 1) What is the Motivation of IAIN Palangka Raya Students to marry during the study period? 2) What is the view of Maqa>s}id Asy-syari> 'ah on marriage during the study period for IAIN Palangka Raya students? This empirical research uses the approach of Islamic law and sociology. The subjects of this research have two categories, namely alumni students and active students, provided that they have married. The research subjects were 8 (people) and 2 (two) informants. Data were analyzed through observation, interviews, and documentation. which is analyzed through Islamic law theory Maqa>s}id Asy-syari> 'ah, action theory and motivation theory. The results of this study are: 1) The motivation of students to marry during the study period is to avoid adultery, to feel compatible with their partners and to need each other as well as support from their families to help the economy. 2) The view of Maqa>s}id Asy-syari> 'ah (hifz} al-Din, hifz} nafs, hifz} al-nasab, hifz} al-aql and hifz} al-mal) towards getting married during the study period of IAIN students Palangka Raya contains benefit and also contains harm that occurs in their marriage. But if it is seen from their main task as real students, getting married during the study period is greater harm than good.
