Abstract
Pemikiran Islam klasik yang bersifat patriakhi banyak dikritisi, dengan argumen bahwa wacana Islam klasik didasarkan pada dalil-dalil dan asumsi yang diskriminatif, dan pada gilirannya melahirkan, standarisasi dan melestarikan relasi gender yang tidak setara antara laki-laki dan perempuan. Fiqh hak perempuan dengan porsi setengah dari hak laki-laki dalam ketentuan warisan, kesaksian dan hukum 'aqiqah. Perempuan dipandang sebagai makhluk yang tidak sempurna, kemampuan intelektual yang lemah, emosional, tidak rasional. Pada gilirannya, semua hal di atas berusaha untuk dianalisis kembali, karena sesungguhnya Al-Qur'an mengajarkan bahwa Islam datang untuk memberikan kenyamanan, ketenangan hidup (rahmatan lil 'alamin).

Classical Islamic thought patriarchal critical scrutiny from many quarters, with the argument that classical Islamic discourse is based on postulates and assumptions are discriminatory, and in turn give birth, standardize and preserve unequal gender relations between men and women. Fiqh of women's rights measuring half the rights of men as in many of the provisions of inheritance, testimony and legal 'aqiqah. Women as imperfect beings (deficient); weak intellectual abilities; unable to master the emotional turmoil; think irrationally. In turn, all of the above attempted to re-analyzed, as we know that the Qur'an teaches that Islam came to give comfort, peace of life (rahmatan lil 'alamin)
