Abstract

Penelitian ini berjudul sertifikasi tanah wakaf dalam perspektif hukum progresif Satjipto Rahardjo, adapun latar belakang penelitian ini adanya sertifikasi tanah wakaf adalah untuk memberikan kepastian dan perlindungan hukum guna menjaga tanah-tanah tersebut terhindar dari sengketa-sengketa yang merugikan tanah wakaf. Akan tetapi sistem pendaftaran tanah di Indonesia yang menggunakan sistem stelsel negatif, membuat kepastian dan perlindungan hukum dalam pendaftaran tanah tidak terjamin. Tidak terjaminnya kepastian hukum memunculkan peluang pembatalan hak atas tanah. Hal ini berimplikasi negatif pada pertumbuhan ekonomi nasional dan pada akhirnya berujung pada menurunnya kesejahteraan masyarakat. Hal tersebut bertentangan dengan Hukum Progresif yang menyatakan hukum seharusnya membawa manusia pada keadilan, kesejahteraan dan kebahagian. Adapun ayng menjadi rumusan masalah adalah (1) Bagaimana ketentuan sertifikasi tanah wakaf di Indonesia dalam perspektif hukum progresif Satjipto Rahardjo? (2) Bagaimana solusi-solusi hukum progresif Satjipto Rahardjo terhadap sertifikasi tanah wakaf di Indonesia? (3) Bagaimana dampak dari penerapan hukum progresif Satjipto Rahardjo terhadap sertifikasi tanah wakaf?
Jenis penelitian ini adalah penelitian kepustakaan, adapun teknik pengumpulan datanya yaitu dengan pengumpulan bahan hukum primer dan bahan hukum sekunder yang disesuaikan dengan isu hukum dan pendekatan yang telah ditetapkan. pendakatan dalam penelitian ini menggunakan pendekatan perundang-undangan dan pendekatan konsep yang dianalisis dengan metode historis, hermeneutika, heuristika.
Temuan dalam penelitian ini adalah (1) Sertifikasi tanah wakaf belum dapat dikatakan progresif sebab belum memenuhi asumsi dasar hukum progresif yaitu hukum untuk manusia dan hukum mengandung moral. (2) solusi hukum hukum progresif terhadap sertifikasi tanah wakaf yaitu perlunya perbaikan di bidang normatif, pemberian diskresi, perbaikan sistem pendaftaran, perbaikan pengelolaan, perbaikan pendidikan, pengotimalan sosialisasi perbaikan sumber daya, (3) Hukum progresif dapat berdampak positif dampak positif dan negatif, dampak positif yaitu meliputi terciptanya kepastian hukum, pengelolaan bermoral, pendidikan lebih progresif, sumber daya manusia. Dan dampak negatif membuat kekaburan pada tanggung jawab para pelaku penyertifikatan.

ABSTRACT

This research is titled certification of waqf land in the progressive legal perspective of Satjipto Rahardjo, while the background of this research is the certification of waqf land to provide certainty and legal protection to keep these lands protected from disputes that are detrimental to endowment land. However, the land registration system in Indonesia, which uses a registration of deeds system, makes certainty and legal protection in land registration insecure. Uncertain legal certainty creates an opportunity to revoke land rights. This has negative implications on national economic growth and ultimately leads to a decline in people's welfare. This is contrary to the Progressive Law which states that law should bring people to justice, prosperity and happiness. As for the formulation of the problem, they are (1) What are the provisions on the certification of waqf land in Indonesia in the perspective of progressive legal Satjipto Rahardjo? (2) What are Satjipto Rahardjo's progressive legal solutions to the certification of waqf land in Indonesia? (3) What is the impact of the application of Satjipto Rahardjo's progressive law to the certification of waqf land?
This type of research is library research, while the data collection techniques are by collecting primary and secondary legal materials that are adjusted to the legal issues and approaches that have been determined. The approach in this study uses a statutory approach and conceptual approach that is analyzed by historical methods, hermeneutics, heuristics.
The findings in this study are (1) The certification of waqf land cannot yet be said to be progressive because it has not fulfilled the basic assumptions of progressive law namely law for humans and law containing morals. (2) progressive legal legal solutions to the certification of waqf land, namely the need for improvements in the normative field, giving discretion, improving the registration system, improving management, improving education, optimizing the socialization of resource improvements, (3) Progressive law can positively impact positive and negative impacts, positive impact which includes the creation of legal certainty, moral management, more progressive education, human resources. And the negative impact makes blurring on the responsibility of the certifier.
