Abstract

Seiring dengan perkembangan zaman, mulai tahun 1962 hadirlah sebuah ritel modern pertama di Indonesia dengan nama Toserba Sarinah yang menjadi cikal bakal kebangkitan usaha ritel modern. Kemudian terus berkembang dengan begitu pesatnya hingga saat ini.

Fokus utama penelitian ini adalah: (1) Bagaimana Peran Pemerintah Daerah terhadap Penataan Usaha Ritel Modern di Kota Palangka Raya, (2) Tinjauan Hukum Islam dalam penataan Usaha Ritel Modern dan Usaha Ritel tradisional di Kota Palangka Raya.

Jenis penelitian ini adalah penelitian normatif empiris, dan termasuk dalam kategori penelitian hukum sosiologis. Subjek penelitian berjumlah 9 orang yaitu1 orang Kepala Seksi Bina Usaha, Pemasaran, Promosi, dan Pendaftaran Perusahaan Pemerintah Kota Palangka Raya, 4 pelaku usaha ritel tradisional, 4 konsumen ritel tradisional serta ritel modern minimarket berupa Alfamart atau Indomaret, dan Dinas Perindustrian & Perdagangan Kota Palangka Raya. Objek penelitian ini, Outlet Ritel Tradisional. Teknik pengumpulan data menggunakan metode wawancara, observasi dan dokumentasi.

Hasil penelitian ini menyimpulkan bahwa: (1) Peran Pemerintah Kota Palangka Raya tentang Penataan Usaha Ritel Modern dalam hal ini berdasarkan Peraturan Daerah Kota Palangka Raya Nomor 04 tahun 2007 tentang Pengelolaan Pasar Modern dalam hal ini telah melakukan pengawasan dan melakukan survey sebelum membrikan ijin berdiri bagi suatu ritel modern. Kehadiran Usaha Ritel Modern di Kota Palangka Raya, terutama Ritel Modern yang memiliki brand ternama seperti Alfamart dan Indomaret sejauh ini memberikan dampak kepada Usaha Ritel Tradisional. (2) Tinjuan Hukum Islam dalam Penataan Usaha Ritel Modern dan Usaha Ritel Tradisional di Kota Palangka Raya dalam hal ini setelah dikaji dengan teori maslahah dan teori maqasid syariah dalam hal ini sangat memperhatikan persaingan usaha yang sehat dan tidak ada unsur curang.

ABSTRACT

Along the times, since 1962 there was first modern retail in Indonesia called the Sarinah Department Store which became the forerunner of the rise of modern retail businesses. Then it continued to grow so rapidly until now.

The main focused on the research were: (1) What is the Role of Regional Governments in Structuring Modern Retail Businesses in Palangka Raya, (2) Overview of Islamic Law in structuring Modern Retail Businesses and Traditional Retail Enterprises in Palangka Raya.

The type of the research was empirical normative research, and belongs to the category of sociological legal research. The research subjects were 9 people, namely 1 person of the Palangka Raya Government Business Development, Marketing, Promotion and Corporate Registration Section Head, 4 traditional retail business actors, 4 traditional retail consumers and a modern retail minimarket in the form of Alfamart or Indomaret, and Palangka Industry & Trade Kingdom. The object of this research was Traditional Retail Outlets. The technique of collecting data used interviews, observation and documentation.

The results of the study concluded that: (1) The role of the City Government of Palangka Raya regarding the Arrangement of Modern Retail Businesses in this case based on the Regional Regulation of Palangka Raya Number 04 of 2007 concerning Modern Market Management in this case has supervised and conducted a survey before allowing permission to stand a modern retailer. The presence of Modern Retail Businesses in Palangka Raya, especially Modern Retail which has well-known brands such as Alfamart and Indomaret so far has an impact on Traditional Retail Businesses. (2) Islamic Law Review in Modern Retail Business Arrangement and Traditional Retail Business in Palangka Raya in this case after being studied with maslahah theory and maqasid syariah theory in this case very concerned about fair business competition and no fraudulent elements.
