Abstract

Majelis hakim Pengadilan Agama Kuala Kurun mengabulkan permohonan isbat nikah suami istri dengan wali muhakkam yang ditunjuk oleh mempelai wanita berdasarkan ketentuan kitab Al-Mugni bahwa mempelai wanita bisa menunjuk sendiri walinya jika tidak punya wali dari pihak keluarga atau tidak ada aparat pemerintah yang bisa menikahkan. Sementara saat pasangan suami istri melangsungkan pernikahan sudah ada pejabat yang bertanggung jawab menikahkan. Permohananisbatnikah juga diterima karena alasan hakim tak boleh berpikiran sempit demi mewujudkan kemaslahatan. Hal ini menarik diteliti dari sisi landasan dan pertimbangan hakim secara kontekstual hukum.

Tujuan penelitian ini untuk mengetahui landasan dan pertimbangan apa saja sehingga hakim berani mengabulkan meski tak sesuai dengan ketentuan kitab Al-Mugni.

Jenis penelitian yang digunakan adalah normatif yang mengkaji Putusan Pengadilan Agama Kuala Kurun Nomor 0004/Pdt.P/2019/PA.Kkn menggunakan pendekatan perundang-undangan, pendekatan konseptual dan pendekatan kasus.

Landasan Hakim Pengadilan Agama Kuala Kurun Dalam Penetapan Isbat Nikah Siri diantaranya doktrin hukum Islam pada Kitab I’anathuth Thalibin dan Kitab al-Mughni serta Pasal 7 ayat (2) dan ayat (3) huruf (e) Kompilasi Hukum Islam. Pertimbangan hakim perspektif kontekstual hukum mengedepankan dari aspek filosofis lemah. Sementara dari sosiologis hakim lebih mengedepankan kepentingan pemohon tanpa memperhatikan kemasalahatan lebih luas dalam tatanan sosial. Dari aspekyuridis atau sisi kepastian hukum, ada pengabaian terhadap sumber hukumyang dijadikan landasan, yakni Kitab Al-Mugni yang dikutip perihal wali muhakkam.

ABSTRACT

The Kuala Kurun religious court judges granted the request for marriage license with a wali muhakkam appointed by the bride based on the provisions of the book of Al-Mugni that the bride can appoint her own guardian if she does not have a guardian from the family or no government officials can marry. Meanwhile, when married couples hold marriages, there are already officials responsible for marrying. Marriage is also accepted for the reason that the judge should not be narrow-minded in order to realize benefit. This is interestingly researched in terms of the foundation and consideration of judges contextually legally.

The purposes of this research are to find out what the basis and considerations are so that the judge dares to grant even if it is not in accordance with the provisions of the book of Al-Mugni.
The type of research used normative that examines the Decision of the Kuala Kurun Religious Court Number 0004 / Pdt.P / 2019 / PA. KKN uses a statutory approach, a conceptual approach and a case approach.

The foundations of the Judges of the Kuala Kurun Religious Court in determining the Siri Marriage Isbat include the doctrine of Islamic law in the Book of I'anathuth Thalibin and the Kitab al-Mughni as well as Article 7 paragraphs (2) and (3) letter (e) of the Compilation of Islamic Law. The judge's consideration of the contextual perspective of the law puts forward from a weak philosophical aspect. While from the sociological the judge puts forward the interests of the petitioner without regard to the wider misconduct in the social order. From the juridical aspect or the side of legal certainty, there is a disregard for the source of the law that is used as a basis, namely the Kitab Al-Mugni which is quoted regarding wali muhakkam.
