Abstract

Penelitian ini dilatarbelakangi karena setiap putusan isbat nikah yang dikabulkan memuat amar putusan meminta KUA setempat untuk mencatat pernikahan pemohon tanpa ada perintah tajdidun nikah. Hal ini terkesan tidak sesuai dengan petunjuk pasal 26 ayat 2 UU No. 1 Tahun 1974 jo UU No 16 Tahun 2019 tentang Perkawinan bahwa setiap perkara pernikahan yang dilakukan “bukan” di depan PPN yang resmi maka nikah tersebut “diperbaharui” supaya sah. Fokus penelitian ini adalah prosesi isbat nikah yang mengabaikan tajdidun nikah, status hukumnya serta bagaiman kajian hukum islam dan positifnya terhadap isbat nikah dan tajdidun nikah.

Hasil penelitian ini: (1) Prosesi isbat nikah yang mengabaikan tajdidun nikah dimulai dari proses pendaftaran ke Pengadilan Agama, lalu proses persidangan hingga putusan dan terakhir proses pencatatan di KUA Kabupaten Pulang Pisau. (2) Status hukum isbat nikah yang mengabaikan tajdidun nikah boleh, karena selama rukun dan syarat nikah terpenuhi maka tidak perlu adanya tajdidun nikah. (3) Secara kajian hukum Islam dan Positif pengajuan isbat nikah bertujuan untuk legalitas pernikahan yang pernah terjadi.

ABSTRACT

This research was motivated by the fact that each decision of the isbat nikah granted contains a decision asking the local KUA to record the applicant’s marriage without any tajdidun nikah orders. It seems inconsistent with the instructions of Article 26 paragraph 2 of Law no. 1 of 1974 in conjunction with Law No. 16 of 2019 concerning Marriage that every marriage case that is carried out "not" in front of the official VAT, the marriage is "renewed" so that it is valid. The focus of this research is the isbat nikah procession that ignores the tajdidun nikah, and its legal status as well as how to study Islamic law and its positives on the isbat nikah and tajdidun nikah?

The results of this study: (1) the position of the isbat nikah that ignores the tajdidun nikah started from the registration process to the Religious Court, then the trial to the court decision, and finally the registration process at KUA Pulang Pisau district. (2) The legal status of isbat nikah that ignores the tajdidun nikah is allowed because as long as the pillars and conditions of marriage are fulfilled, there is no need for tajdidun nikah. (3) In the study of Islamic law and positively, the submission of isbat nikah aims to the legality of marriages that have occurred.
