Abstract

Penelitian tentang problematika pengelolaan tanah wakaf di mesjid Nurul Mustofa Kecamatan Jekan Raya Kota Palangka Raya tersebut memang mengalami sengketa tanah yang terjadi dalam pengelolaan tanah wakaf, diantaranya pengklaiman tanah oleh orang yang mengakui sebagian dari tanah wakaf tersebut berasal dari kepemilikan tanah nenek moyangnya yang memiliki surat segel dan surat garapan, sehingga dasar tersebut menjadikan alasan mendirikan bangunan masyarakat yang berdiri di atas tanah wakaf tersebut. Fokus penelitian ini tentang: 1) Bagaimana manajemen pengelolaan tanah wakaf di mesjid Nurul Mustofa Kecamatan Jekan Raya Kota Palangka Raya; 2) Apa yang menjadi problematika pengelolaan tanah wakaf di mesjid Nurul Mustofa Kecamatan Jekan Raya Kota Palangka Raya; 3) Bagaimana kajian manajemen penyelesaian tanah wakaf di mesjid Nurul Mustofa Kecamatan Jekan Raya Kota Palangka Raya untuk kedepannya. Penelitian ini menggunakan metode kualitatif, dengan mengambil data melalui wawancara, observasi dan dokumentasi. Objek adalah pengelolaan tanah wakaf. Subjek pengelolaan (pengurus mesjid Nurul Mustofa Kecamatan Jekan Raya Kota Palangkaraya). Hasil penelitian ini (1) sistem manajemen pengelolaan tanah wakaf di mesjid Nurul Mustofa masih kurang baik karena hanya memiliki pembukuan atau bukti dokumentasi atas tanah wakaf saja, tetapi harus dikelola dengan baik dengan dibuat pagar keliling minimal berupa kawat berduri yang menandakan bahwa tanah kosong itu dimiliki oleh Mesjid Nurul Mustofa. (2) Problematika pengelolaan tanah wakaf di mesjid Nurul Mustofa Kecamatan Jekan Raya Kota Palangka Raya adalah tentang sengketa tanah wakaf yang dalam sertifikat itu telah terdapat sertifikat rumah salah satu masyarakat sekitar mesjid. (3) Kajian manajemen penyelesaian tanah wakaf di mesjid Nurul Mustofa Kecamatan Jekan Raya Kota Palangka Raya untuk kedepannya adalah pihak nazhir pengelola pengurus mesjid agar berkoordinasi dengan pihak ahli hukum (pengacara) untuk membuat gugatan atau permohonan terkait dengan problematika tumpang tindih sertifikat dan bangunan di atas tanah wakaf mesjid Nurul Mustofa yang telah memiliki sertifikat. Dan permohonan tersebut diajukan ulang ke sidang litigasi.

ABSTRACT

The research on the problems of waqf land management at the Nurul Mustofa mosque, Jekan Raya District, Palangka Raya City did experience land disputes that occurred in the management of waqf land, including land claims by people who acknowledged that part of the waqf land came from the land ownership of their ancestors who had seals. and a claim letter, so that the basis is the reason for establishing a community building that stands on the waqf land. The focus of this research is on: 1) How is the management of waqf land in the Nurul Mustofa mosque, Jekan Raya District, Palangka Raya City; 2) What are the problems with waqf land management at the Nurul Mustofa mosque, Jekan Raya District, Palangka Raya City; 3) How to study the management of waqf land settlement at the Nurul Mustofa mosque, Jekan Raya District, Palangka Raya City for the future. This study uses qualitative methods, by taking data through interviews, observation and documentation. The object is the management of waqf land. The subject of management (the administrator of the Nurul Mustofa mosque, Jekan Raya District, Palangkaraya City). The results of this study (1) the management system for waqf land management at the Nurul Mustofa mosque is still not good because it only has books or documentary evidence of waqf land, but it must be managed properly by making a minimum perimeter fence in the form of barbed wire which indicates that the vacant land is owned. by Masjid Nurul Mustofa. (2) The problem of waqf land management at the Nurul Mustofa mosque, Jekan Raya District, Palangka Raya City is about the waqf land dispute in which the certificate has a certificate of the house of one of the people around the mosque. (3) The study of the management of the settlement of waqf land at the Nurul Mustofa mosque, Jekan Raya District, Palangka Raya City, in the future, Nazhir who manages the mosque management must coordinate with legal experts (lawyers) to make a lawsuit or request related to the problem of overlapping certificates and the building above. waqf land of the Nurul Mustofa mosque which already has a certificate. And the application was resubmitted to the litigation trial.
