Abstract
Penelitian ini dilatar belakangi adanya orangtua merantau di Desa Maliku Mulia Kecamatan Maliku Kabupaten Pulang Pisau, dalam pelaksanaan kewajibanya sebagai orangtua melimpahkan tangung jawabnya terhadap anak kepada yang diberi kepercayaan. Penelitian ini difokuskan pada implementasi kewajiban orangtua yang merantau terhadap anak dan Tinjauan hukum islam mengenai pelimpahan kewajiban orangtua merantau di Desa Maliku Mulia. Penelitian ini termasuk penelitian empiris dalam hukum Islam. Dikaji melalui pendekatan kualitatif deskriptif dan hukum Islam (socio-legal) yang dianalisis melalui teori parenting dan teori maqāṣid al-syarīʿah. Adapun hasil dari penelitian ini adalah: (1)kewajiban orangtua terhadap anak dalam pemenuhan tangung jawab tidak terpenuhi secara utuh . Seperti menumbuh kembangkan bakat sesuai dengan minatnya, sebab bukan menjadi titik fokus orangtua. Serta pendidikan karakter pada anak tidak dapat terpenuhi, dikarenakan tidak ada pembicaraan yang berkualitas dan juga intensitas komunikasi yang mendukung. Selain itu dalam hal pengasuhan, pemeliharaan, pengawasan, perlindungan telah di laksanakan sebagaiamana mestinya berdasarkan ketentuan dalam pasal undang-undang yang berlaku.(2) Berdasarkan tinjauan hukum Islam mengenai pelimpahan tanggung jawab orangtua yang merantau terhadap anak di Desa Maliku Mulia Kecamatan Maliku Kabupaten Pulang Pisau, hukumnya adalah mubah (boleh). Karena, terpenuhinya pangan, sandang, papan merupakan kebutuhan Primer yang harus dipenuhi oleh setiap orangtua terhadap anaknya. Apabila kebutuhan tersebut tidak terpenuhi maka dapat berpengaruh pada kelangsungan hidup anak dan keharmonisan dalam rumah tangga.
ABSTRACT
This research is motivated by the existence of parents wandering in the village of Maliku Mulia, Maliku sub-district, Pulang Pisau district, in carrying out their obligations as parents, they delegate their responsibilities to their children to those who are trusted. This research is focused on the implementation of the obligations of parents who migrate to their children and a review of Islamic law regarding the delegation of obligations of parents in the village of Maliku Mulia. This research includes empirical research in Islamic law. It is examined through a descriptive qualitative approach and Islamic law (socio-legal) which is analyzed through parenting theory and maqāṣid al-syarīʿah theory.The results of this study are: (1) the obligations of parents to children in fulfilling their responsibilities are not fully fulfilled. such as developing talents according to their interests, because they are not the focal point of parents. And character education in children cannot be fulfilled, because there is no quality talk and also the intensity of supportive communication. In addition, in terms of care, maintenance, supervision, protection has been carried out properly based on the provisions in the articles of the applicable law. (2) Based on a review of Islamic law regarding the delegation of responsibilities of parents who migrate to children in Maliku Mulia Village, Maliku District, Pulang Pisau Regency, the law is permissible (permissible). Because, the fulfillment of food, clothing, housing are primary needs that must be met by every parent for their child. If these needs are not met, it can affect children's lives and harmony in the household.
