Abstract

Penelitian ini dilatarbelakangi masih ada pemilik bengkel servis motor di kota Palangaka Raya mengambil manfaat dari ban bekas milik konsumen, padahal ban bekas tersebut adalah masih hak milik dari konsumen karna tidak adanya ijin memanfaatkan ban tersebut. Fokus penelitian tidak adanya akad dalam jasa servis motor di kota Palangka Raya Dan bagaimana status kepemilikan ban bekas pada jasa servise motor di kota Palangka Raya. Jenis penelitian adalah hukum empiris dengan pendekatan penelitian sosio-legal. Subjek penelitian ini adalah tiga pemilik bengkel motor dan 6 konsumen di Kota Palangka Raya. Data penelitian yang dihimpun dengan metode observasi, wawancara dan dokumentasi, dianalisis secara deskriptif kualitatif. Hasil penelitian ini menunjukan 1). Alasan akad ganti ban bekas pada jasa servis bengkel motor di Kota Palangka Raya, bahwa tidak ada akad dalam transaksinya karna kurangnya pemahaman tentang akad. 2). Status kepemilikan ban bekas pada jasa servis, ban bekas yang diambil tanpa izin oleh pemilik bengkel diperbolehkan asalkan ada persetujuan atau keridhaan dari konsumen pemilik ban bekas. Dan sudah menjadi kebiasaan masyarakat Kota Palangka Raya sehingga hal ini adalah boleh karena kebiasaan tersebut telah terjadi terus-menerus dan tidak menimbulkan masalah. Sehingga kepemilikan ban bekas dapat dimiliki oleh pihak pemilik bengkel.

ABSTRACT

The background of this research is that there are still owners of motorcycle service workshops in the city of Palangkaka Raya who take advantage of used tires belonging to consumers, even though these used tires are still the property of consumers because there is no permit to use these tires. The focus of the research is the absence of a contract in motorcycle service services in the city of Palangka Raya. And how is the status of ownership of used tires in motorcycle servicing services in the city of Palangka Raya. This type of research is empirical law with a socio-legal research approach. The subjects of this study were three motorcycle repair shop owners and 6 consumers in Palangka Raya City. The research data collected by the method of observation, interviews and documentation, were analyzed descriptively and qualitatively. The results of this study show 1). Reason contract for changing used tires at a motorcycle repair shop in Palangka Raya City, that there is no contract in the transaction due to a lack of understanding of the contract. 2). The ownership status of used tires in service services, used tires taken without permission by the workshop owner are allowed as long as there is approval or the pleasure of the used tire owner's consumer. And it has become a habit of the people of Palangka Raya City so that this is permissible because this habit has occurred continuously and does not cause problems. So that the ownership of used tires can be owned by the workshop owner.
