Abstract

This study examines the mandatory rules for Covid-19 vaccination in the context of dealing with the Covid-19 pandemic in Presidential Regulation Number 14 of 2021 which requires people who are targeted by vaccination recipients to vaccinate Covid-19 for people who refuse vaccination will be subject to sanctions in the form of administrative witnesses and fines. The problem is that there are articles in the positive law that contradict the mandatory vaccination rules and according to the criteria for the formation of legislation in the siyasa suariyah, the mandatory Covid-19 vaccination rules do not meet these criteria. This study uses library
research (library research). The data and materials are obtained through reading, citing books, researching, analyzing documents, news on the internet and related laws for discussion. After the data/materials have been collected, they are processed in a descriptive qualitative way and analyzed in a deductive way. This study found that the Presidential Regulation regarding mandatory vaccination regulations by emphasizing penalties in the form of administrative sanctions and fines for refusal of Covid-19 vaccination is contrary to the articles contained in positive law and according to the fiqh perspective of siyasa dusturiyah these regulations do not meet the criteria of legislation. which is good according to siyasa syar'iyah.
