Abstract
Abstract
Royal Zarmina Residence merupakan perumahan syariah pertama di Kota Palangka Raya, yang mana dalam mekanisme transaksi yang dilkukan menggunakan konsep yang sesuai dengan syariat Islam. Tujuan dari penelitian ini ialah untuk mengetahui dan menganalisis (1) Bagaimana Mekanisme Transaksi Kepemilikan Rumah Melalui Developer Royal Zarmina Residence di Kota Palangka Raya (2). Bagaimana Tinjauan Ekonomi Islam Terhadap Transaksi Kepemilikan Rumah Melalui Developer Royal Zarmina Residence di Kota Palangka Raya.
Penelitian ini merupakan penelitian lapangan dengan menggunakan metode kualitatif. Adapun subjek dalam penelitian ini adalah 2 orang developer Royal Zarmina Residence dan 3 orang konsumen Royal Zarmina Residence. Teknik pengumpulan data dalam penelitian ini adalah observasi, wawancara dan dokumentasi, kemudian dianalisis melalui tahapan data collection, data reduction, data display, dan conclusion drawing.
Hasil dari penelitian ini adalah (1) Mekanisme transaksi rumah melalui Royal Zarmina Residence bisa dilakukan secara cash maupun kredit jika secara kredit maka konsumen membayar DP 30% pembangunan akan dilakukan dibulan ke 7 setelah angsuran baru dibangun rumahnya. Dalam proses pembuataan sertifikat hak milik pada Royal Zarmina Residence, untuk sertifikat kepemilikan rumah atas nama pembeli dan akan diserahkan apabila ada jaminan yang diberikan pembeli saat yang membeli secara kredit atau pembayaran dilakukan secara cash maka sertifikat akan langsung diserahkan pada saat serah terima bangunan. (2). Tinjauan ekonomi Islam terhadap mekanisme transaksi yang dilakukan oleh Royal Zarmina Residence menggunakan dua akad yakni akad Istishna dan akad Murabahah. Akad Istishna yang dilakukan oleh Royal Zarmina Residence sudah sesuai dengan fatwa DSN MUI nomor 06/DSN-MUI/IV/2000 tentang akad jual beli Istishna.Namun untuk akad Murabahah yang mereka lakukan belum bisa dikatakan sesuai dengan fatwa DSN MUI nomor 111/DSN-MUI/IX/2017 tentang akad jual beli Murabahah, karena sampai saat ini belum ada konsumen Royal Zarmina Residence yang memilih melakukan transaksi menggunakan akad ini.
ABSTRACT
Royal Zarmina Residence is the first sharia housing in Palangka Raya City, where the transaction mechanism uses a concept that is in accordance with Islamic law. The purpose of this study is to determine and analyze (1) How is the Residential Ownership Transaction Mechanism through the Royal Zarmina Residence Developer in Palangka Raya City (2). How an Islamic Economic Review of Residential Ownership Transactions through the Developer of Royal Zarmina Residence in Palangka Raya City.
This research is a field research using qualitative methods. The subjects in this study were two persons whom are Royal Zarmina Residence developers and three persons whom are Royal Zarmina Residence consumers. Data collection techniques in this research are observation, interviews and documentation, then analyzed through the stages of data collection, data reduction, data display, and conclusion drawing.
The results of this study are (1) The mechanism of house transactions through the Royal Zarmina Residence can be done in cash or credit. If on credit, the consumer pays 30% down payment, the construction will be carried out in the 7th month after the new house is built. In the process of making a certificate of ownership at the Royal Zarmina Residence, for a certificate of home ownership in the name of the buyer and it will be submitted if there is a guarantee given by the buyer when buying on credit or payment is made in cash, the certificate will be immediately submitted at the time of handover of the building. (2). The Islamic economic review of the transaction mechanism carried out by Royal Zarmina Residence uses two contracts, namely the Istishna contract and the Murabahah contract. The Istishna contract carried out by Royal Zarmina Residence is in accordance with the DSN MUI fatwa number 06 / DSN-MUI / IV / 2000 regarding the Istishna sale and purchase agreement. However, for the Murabahah contract they cannot say in accordance with the DSN MUI fatwa number 111 / DSN-MUI / IX / 2017 concerning the Murabahah sale and purchase agreement, because until now there has been no Royal Zarmina Residence customer who has chosen to make transactions using this contract.
