Abstract

Penelitian ini dilatarbelakangi kurang optimalnya pengawasan yang dilakukan instansi terkait peredaran produk kosmetik ilegal di media online di Kota Palangka Raya yang menakibatkan rentanya posisi konsumen. Fokus penelitian ini adalah mengkaji pengawasan yang dilakukan instansi terkait terhadap praktik peredaran produk kosmetik ilegal di media online. Adapun rumusan masalahnya adalah (1) Mengapa masih terjadinya peredaran masker organik ilegal yang diperjual belikan melalui media online di kota Palangka Raya? (2) Bagaimana cara instansi terkait dalam mengatasi peredaran kosmetik ilegal yang diperjual belikan melalui media online di kota Palangka Raya? Penelitian empiris ini lebih mengarah pada tipe penelitian yuridis sosiologis menggunakan pendekatan socio-legal. Objeknya adalah pelaksanaan pengawasan dari ketiga instansi yakni Balai Besar Pengawas Obat dan Makanan (BBPOM) Kota Palangka Raya, Disnas Perdagangan dan Perindustrian Kota Palangka Raya, dan Dinas Komunikasi Informatiak Statistik dan Persandian Kota Palangka Raya terkait peredaran kosmetik ilegal melalui media online di kota Palangka Raya. Data penelitian dihimpun dengan metode observasi, wawancara dan dokumentasi. Hasil penelitian ini menunjukkan bahwa alasan masih adanya peredaran kosmetik ilegal di media online disebabkan oleh dua faktor yaitu rendahnya tingkat kesadaran hukum pelaku usaha yang masih berada pada tingkat pertama yakni pengetahuan hukum, serta masih kurang optimalnya pengawasan yang dilakukan oleh pemerinta. Kemudian cara yang dilakukan BBPOM dan instansi lain dalam mengatasi peredaran kosmetik ilegal di media online seperti memperkuat sistem pengawasan dengan membaut inovasi terbaru terdahap pengawasan secara online, meningkatkan koordinasi dengan berbagai pihak seperti yang dijelaskan dalam Inpres Nomor 3 Tahun 2017 Tentang Peningkatan Efektifitas Pengawasan Obat dan Makanan, serta perlunya partisifasi aktif dari masyarakat.

ABSTRACT

This research is motivated by the lack of optimal supervision carried out by agencies related to the circulation of illegal cosmetic products in online media in Palangka Raya City which resulted in the vulnerability of consumers' positions.The focus of this research is to examine the supervision carried out by relevant agencies on the practice of circulating illegal cosmetic products in online media. The formulation of the problem is (1) Why is there still illegal circulation of organic masks that are traded through online media in the city of Palangka Raya? (2) How do the relevant agencies deal with the circulation of illegal cosmetics traded through online media in the city of Palangka Raya? This empirical research is more directed to the type of socio-juridical research using a socio-legal approach. The object is the implementation of supervision from the three agencies, namely the Center for Drug and Food Control (BBPOM) of Palangka Raya City, the Office of Trade and Industry of Palangka Raya City, and the Office of Information and Communication Statistics and Encoding of the City of Palangka Raya regarding the circulation of illegal cosmetics through online media in the city of Palangka Raya. The research data were collected by using the methods of observation, interviews and documentation. The results of this study indicate that the reason for the existence of illegal cosmetic circulation in online media is caused by two factors, namely the low level of legal awareness of business actors who are still at the first level, namely legal knowledge, and the lack of optimal supervision by the government. Then the method used by BBPOM and other agencies in overcoming the circulation of illegal cosmetics in online media, such as strengthening the supervision system by making the latest innovations for online supervision, increasing coordination with various parties as described in Presidential Instruction Number 3 of 2017 concerning Increasing the Effectiveness of Drug and Food Control. , as well as the need for active participation from the community.
