Abstract

Penelitian ini dilatarbelakangi dengan jumlah produk UMKM yang bersertifikat halal di Kalimantan Tengah cenderung sedikit, dengan disahkannya UUJPH pada pasal 44 maka lembaga keagamaan atau organisasi masyarakat yang sudah berbadan hukum dapat memfasilitasi sertifikasi halal produk UMKM. Fokus penelitian ini adalah bagaimana respon ormas keagamaan Muhammadiyah dan Nahdatul ulama terhadap ketentuan pasal 44 UUJPH mengenai fasilitasi sertifikasi halal bagi UMKM, bagaimana peran ormas keagamaan Muhammadiyah dan Nahdatul Ulama dalam pelaksanaan fasilitasi sertifikasi halal bagi UMKM. Jenis penelitiaan ini adalah penelitian hukum empiris atau bisa disebut hukum sosiologis (socio legal research). Subjek penelitian ini adalah PW Muhammadiyah dan PWNU tingkat provinsi Kalimantan Tengah. Adapun pendekatan yang digunakan adalah pendekatan kualitatif dengan teknik pengumpulan data berupa wawancara, observasi, dan dokumentasi. Hasil penelitian ini: (1) Respon ormas keagamaan Muhammadiyah dan Nahdatul Ulama Provinsi Kalimantan Tengah berbeda-beda, ada yang masih berupa perencanaan, ada yang sudah melakukan tindakan dan ada yang masih berupa penilaian terhadap ketentuan pasal 44 UUJPH mengenai fasilitasi sertifikasi halal. Namun semuanya menyambut dengan baik dan bersyukur atas keterlibatan ormas keagamaan dapat memfasilitasi sertifikasi halal produk UMKM. (2) Peran ormas keagamaan Muhammadiyah dan Nahdatul Ulama Kalimantan Tengah sudah berperan berdasarkan tiga indikator peran aktif, peran partisipatif dan peran pasif, untuk memberikan perlindungan hukum secara preventif pada pelaksanaan sertifikasi halal produk UMKM, akan tetapi belum terlaksana secara maksimal.

ABSTRACT

This research is motivated by the number of halal-certified MSME products in Central Kalimantan tends to be low, with the ratification of UUJPH in article 44, religious institutions, or community organizations that are already legal entities can facilitate halal certification of MSME products. The focus of this research is How is the response of Muhammadiyah and Nahdatul Ulama religious organizations to the provisions of Article 44 UUJPH regarding the facilitation of halal certification for MSMEs, how is the role of Muhammadiyah and Nahdatul Ulama religious organizations in the implementation of facilitation of halal certification for MSMEs. This type of research is empirical legal research or can be called(socio-legal researchsocio legal research). The subjects of this study were PW Muhammadiyah and PWNU at the provincial level of Central Kalimantan. The approach used is a qualitative approach with data collection techniques in the form of interviews, observations, and documentation. The results of this study: (1) The responses of Muhammadiyah and Nahdatul Ulama religious organizations in Central Kalimantan Province are different, some are still in the form of planning, some have taken action and some are still in the form of an assessment of the provisions of Article 44 UUJPH regarding the facilitation of halal certification. However, all of them welcomed and were grateful for the involvement of religious organizations in facilitating the halal certification of MSME products. (2) The role of Muhammadiyah and Nahdatul Ulama religious organizations in Central Kalimantan has played a role based on three indicators of an active role, participatory role, and passive role, to provide preventive legal protection in the implementation by halal certification of MSME products, but this has not been maximally implemented.
