Abstract

Abstract

Berawal dari pengemudi ojek online (gojek) banyak yang melakukan pengalihan akun dengan berbagai alasan, yang dilakukan tanpa sepengetahuan dari PT. Aplikasi Karya Anak bangsa. Berdasarkan latar belakang tersebut rumusan masalah dalam penelitian ini adalah 1. Bagaimana Pengalihan Hak penggunaan akun Gojek di Kota Palangka Raya? 2. Bagaimana akibat hukum hak penggunaan akun Gojek di Kota Palangka Raya? Penelitian ini menggunakan pendekatan kualitatif deskriptif dengan jenis penelitian lapangan, menggunakan teknik purposive Sampling. Hasil penelitian ini adalah pengalihan akun gojek di Kota Palangka Raya 1). pengalihan akun gojek di Kota Palangka Raya yaitu bertujuan untuk membantu orang lain yang belum bekerja pada musim pandemi covid-19 yang sangat susah untuk mendapatkan pekerjaan. Bentuk penyewaan akun gojek dalam keterangan tidak dijelaskan, akan tetapi bentuk yang disewakan berupa akun gojek dari driver yang menyewakan kepada orang lain. Syarat dalam penyewaan akun gojek secara umum tidak ada yang mengatur baik itu dari perjanjian yang dilakukan, hanya saja ada beberapa aturan dari aplikasi gojek yang mengharuskan untuk verifikasi muka setiap awal mengaktifkan aplikasi. Setiap para penyewa diwajibkan untuk verifikasi muka. 2). Perusahaan gojek berhak untuk tidak memfasilitasi atau memberikan layanan kepada para driver yang terbukti melakukan pengalihan akun gojek. Para customer wajib melaporkan akun driver gojek yang terbukti antara pemilik akun berbeda maka akan segera ditindak lanjuti oleh PT. Aplikasi Karya Anak Bangsa, sanksi yang dilakukan bisa berupa suspend atau nonaktif akun secara permanen. Secara teori tanggung jawab permasalahan pengalihan akun gojek yang ada di Kota Palangka Raya yaitu kesalahan dalam pengalihan akun gojek yang ada di Kota Palangka Raya di dalam syarat dan ketentuan yang ada diperusahan aplikasi gojek sudah dijelaskan bahwasanya pengalihan akun gojek baik itu driver maupun customer merupakan sesuatu yang dilarang untuk dilakukan karena segala sesuatu halnya perusahan gojek tidak dapat bertanggung jawab karena segala kerugian dan keamanan yang ditimbulkan karena pengalihan akun gojek dan terakhir Resiko ketika melakukan pengalihan akun gojek tersebut nonaktif sementara atau akun gojek tersebut dinonaktifkan permanen.

ABSTRACT

Starting from so many online drivers (Gojek) that doing sale and purchase activity and renting their accounts for various reasons. These sale and purchase or renting driver accounts are done without the knowledge by PT. Aplikasi Karya Anak bangsa makes the rights and obligations of the company with the drivers become unclear because of the differences in the data that applied and the driver who is running it, this raises the possibility of violation. Based on this, the background problems in this study are 1.) How is the transfer of the Right to use Gojek account in Palangka Raya? 2. What are the legal consequences of the renting agreement in the transfer of the right to use Gojek account in Palangka Raya? This study uses a descriptive qualitative approach with a field research type, using purposive sampling technique. Based on the results of the analysis of data collected, in the process of Gojek account transfer that occurred in Palangka Raya city is causing by the previous drivers that no longer used it because they already have other job and there are also those who already have permanent job. In addition, because the former user already has a permanent job, they renting their account to someone else. In addition, the reason for the transfer of Gojek account is to help others who have not worked in this covid-19 pandemic season that is very difficult to get a job. There are values or benefits in renting a Gojek account which is helping others to get a job and the benefits of renting an account is each month the previous user will earn additional income. The form of renting a Gojek account in general is not explained, but the rented form is a Gojek account from a driver who rents out to someone else. The terms in renting a Gojek account in general are not regulated either by the agreement made, there are only a few rules of the Gojek application that require for face verification in each initial activation of the application. Each tenant is required to verify in advance to the lessee of the Gojek account by direct payment of the lease account or by transfer to the account that renting the Gojek account, the payment fulfilled by transfer every month, because some drivers want such payment to facilitate the tenant due to funds from Go-pay payment method. Gojek application can transfer to bank for example to Bank BCA. The payment period in Gojek account rental varies, some apply per day, per week and some other per month. Renting a Gojek account in its flexible payment system means according to the ability of the tenant, for the payment is Rp. 70.000,00 per week or with a month about Rp. 300.000,00.
