Abstract

Abstract

Penelitian ini dilatarbelakangi oleh adanya kasus perselisihan hubungan industrial pada saat ini di Provinsi Kalimantan Tengah, khususnya di Kota Palangka Raya, dimana perusahaan memberhentikan para pekerjanya secara sepihak sehingga hal tersebut menimbulkan keberatan dari pihak pekerja. Fokus Penelitian ini adalah (1) Terjadinya pemberhentian hubungan kerja antara Yayasan DH GCS dengan Kepala Sekolah SMA GCS. (2) Upaya mediator dalam penyelesaian perselisihan hubungan industrial, dan (3) Kajian hukum ekonomi syari’ah terhadap perselisihan hubungan industrial di Dinas Tenaga Kerja dan Transmigrasi Provinsi Kalimantan Tengah. Data penelitian dihimpun dengan metode wawancara, observasi dan dokumentasi, dianalisa secara deskriptif kualitatif. Hasil penelitian ini menunjukan bahwa terjadinya pemberhentian hubungan kerja terhadap Kepala Sekolah SMA GCS adalah karena Kepala Sekolah tersebut sudah tidak dapat bekerja sesuai visi misi GCS. Upaya yang mediator lakukan adalah meneliti berkas perkara, memanggil para pihak dan melaksanakan sidang mediasi. Kajian hukum ekonomi syari’ah terhadap perselisihan hubungan industrial di Dinas Tenaga Kerja dan Transmigrasi Provinsi Kalimantan Tengah pada perselisihan antara Yayasan DH GCS dengan Kepala Sekolah SMA GCS adalah tidak sesuai dengan akad ija>rah, al-ujrah dan Undang-Undang Ketenagakerjaan karena pemberhentian hubungan kerja tersebut dilakukan secara sepihak dan tanpa membayar hak-hak sebagaimana ketentuan yang berlaku, seharusnya pihak Yayasan membayarkan uang pesangon, uang penghargaan masa kerja dan uang penggantian hak yang seharusnya diterima Kepala Sekolah sebagai akibat dari pemberhentian hubungan kerja.

ABSTRACT

This research is motivated by the current case of industrial relations disputes in Central Kalimantan Province, especially in Palangka Raya City, where the company terminates its workers unilaterally so that this raises objections from the workers. The focus of this research is (1) The termination of the employment relationship between the DH GCS Foundation and the Principal of the GCS Senior High School. (2) Mediation efforts in resolving industrial relations disputes, and (3) Sharia economic law studies on industrial relations disputes at the Manpower and Transmigration Office of Central Kalimantan Province. Research data collected by interview, observation and documentation methods, analyzed descriptively qualitatively. The results of this study indicate that the termination of the employment relationship of the GCS Senior High School Principal is because the Principal is no longer able to work according to the GCS's vision and mission. The mediator's efforts are to examine case files, summon the parties and carry out mediation sessions. The study of sharia economic law on industrial relations disputes at the Manpower and Transmigration Office of Central Kalimantan Province on the dispute between the DH GCS Foundation and the Principal of the GCS Senior High School is not in accordance with the ija>rah, al-ujrah contract and the law. In the Manpower Act, because the termination of the employment relationship was carried out unilaterally and without paying the rights as applicable, the Foundation should have paid severance pay, service fees and compensation payments that should have been received by the Principal as a result of the termination of the employment relationship.
