Abstract

Penelitian ini dilatarbelakangi permasalahan terkait pendirian toko modern yang masih tidak sesuai dengan pasal 12 Peraturan Daerah No. 17 tahun 2014 tentang Toko Modern yang menjelaskan bahwa minimarket berjarak minimal 0,5 Km dari pasar/ toko tradisional dan 0,5 Km dari usaha kecil sejenis yang terletak di pinggir kolektor/arteri. Fokus penelitian ini yaitu bagaimana pengawasan lokasi dan jarak tempat usaha Perdagangan di Kota Palangka Raya dan efektivitas Peraturan Daerah No. 17 tahun 2014 tentang Toko Modern. Metode penelitian yang digunakan adalah yuridis empiris dengan pendekatan sosio-legal melalui observasi, wawancara dan dokumentasi. Subjek penelitian ini adalah Dinas Perdagangan, Koperasi, Usaha Kecil Menengah dan Perindustrian Kota Palangka Raya. Hasil penelitian menunjukkan bahwa pengawasan Lokasi dan Jarak Tempat Usaha Perdagangan Toko Modern di Kota Palangka Raya dilakukan berdasarkan pengawasan langsung dan tidak langsung oleh Dinas Perdagangan, Koperasi, Usaha Kecil Menengah dan Perindustrian Kota Palangka Raya. Pengawasan langsung dilakukan setiap triwulan 5-6 kali, sedangkan pengawasan tidak langsung melalui adanya laporan penanggung jawab dari toko modern. Evektifitas penerapan Peraturan Daerah No. 17 tahun 2014 tentang Toko Modern terutama dalam hal pengawasan terhadap lokasi dan jarak usaha toko modern masih belum evektif dikarenakan dari 55 toko modern di Kota Palangka Raya yang sudah mendapatkan izin terdapat 3 diantaranya masih tidak sesuai aturan Peraturan Daerah No. 17 tahun 2014 pasal 12. Berdasarkan teori berdasarkan teori Maqāṣid Syari͞͞’ah dalam penentuan kemaslahatan umum (maslahah ammah) maka ada Peraturan Daerah Kota Palangka Raya Nomor 17 Tahun 2014 tentang toko modern di Kota Palangka Raya terutama dalam hal penetapan kebijakan terkait lokasi dan jarak tempat usaha bagi toko modern terhadap toko tradisonal sudah sejalan dan memenuhi ketentuan sebagaimana dalam kriterian penetapan kemaslahatan umum.

ABSTRACT

This research was motivated by problems related to the establishment of modern shops which are still not in accordance with Article 12 of Regional Regulation no. 17 of 2014 concerning Modern Stores which explains that minimarkets are at least 0.5 Km away from traditional markets/stores and 0.5 Km from similar small businesses located on the edge of collectors/arteries. The focus of this research is how to monitor the location and distance of the trading business in Palangka Raya City and the effectiveness of Regional Regulation no. 17 of 2014 concerning Modern Stores. The research method used is empirical juridical with a socio-legal approach through observation, interviews and documentation. The subject of this research is the Department of Trade, Cooperatives, Small and Medium Enterprises and Industry of Palangka Raya City. The results showed that the supervision of the Location and Distance of Modern Store Trading Business Places in Palangka Raya City was carried out based on direct and indirect supervision by the Office of Trade, Cooperatives, Small and Medium Enterprises and Industry of Palangka Raya City. Direct supervision is carried out every 5-6 times quarterly, while indirect supervision is through reports from the person in charge of modern stores. The effectiveness of the implementation of Regional Regulation No. 17 of 2014 concerning Modern Stores, especially in terms of monitoring the location and distance of modern shop businesses, it is still not effective because of the 55 modern shops in Palangka Raya City that have received permits, 3 of them are still not in accordance with Regional Regulation no. 17 of 2014 article 12. Based on the theory based on Maqāṣid Syari͞͞'ah theory in determining the public benefit (maslahah ammah), there is a Palangka Raya City Regional Regulation Number 17 of 2014 concerning modern shops in Palangka Raya City, especially in terms of determining policies related to the location and distance of business places for modern stores to traditional stores, it is in line and meets the provisions as stated in the criteria for determining the general benefit.
