Abstract

Penelitian ini dilatarbelakangi banyaknya masyarakat Desa Muara Plantau yang nikahnya tidak tercatat di KUA, menurut observasi awal penulis diakibatkan belum pernah ada sosialisasi UU perkawinan dari KUA Kec. Pematang Karau, sehingga masyarakat belum tahu akibat buruk dari nikah tidak tercatat, karena selama ini walaupun masyarakat nikahnya tidak tercatat akan tetapi masih bisa membuat KK, KTP dan Akta kelahiran anak. Rumusan masalah dalam penelitian ini ada dua yang pertama Mengapa masyarakat Desa Muara Plantau masih mempraktekkan nikah dibawah tangan padahal mereka paham dan yang kedua Bagaimana solusi hukum terhadap permasalahan pernikahan yang tidak tercatat tersebut. Oleh karena itu penelitian ini difokuskan pada pemahaman masyarakat tentang pencatatan nikah yang penulis kaji melalui pendekatan kualitatif deskriftif dan jenis penelitian Hukum empiris yuridis sosiologis atau disebut dengan kualitatif-lapangan. Hasil penelitian ini yakni: (1) Yang menjadi alasan masyarakat masih mempraktekkan pernikahan bawah tangan/tidak tercatat yakni, pertama: ketidaktahuan bahwa pentingnya pencatatan nikah karena belum pernah ada sosialisasi dari KUA dan masyarakat yang menikah tidak tercatat masih bisa membuat KK, KTP dan Akta kelahiran anak kedua: adanya anggapan dari masyarakat yang sudah menjadi orang tua, yang penting sah secara Agama dan sah secara Negara tidak terlalu dianggap penting, ketiga: ada yang menikah masih dibawah umur, keempat: letak KUA yang sulit dijangkau, ini terjadi pada saat Barito Sekatanbelum dipecah menjadi dua kabupaten, (2) Solusi hukum bagi nikah tidak tercatat; secara keseluruhan dari keenam subjek menjawab untuk memberikan solusi hukum bagi yang menikah dibawah tangan pertama: harus diadakannya sosialisasi dari KUA ke Desa Muara Plantau, jika KUA belum bisa turun secara langsung bisa bekerja sama dengan aparat desa, kedua: isbat nikah kalaupun tidak bisa dilakukan perorangan, diharapkan agar kepada Desa membuat surat permohonan isbat nikah keliling.

Abstract

This research is motivated by the many people of Muara Plantau Village whose marriages are not recorded in the KUA, according to the author's initial observations due to no socialization of the Marriage Law from the KUA Kec. Pematang Karau, so that people do not know the bad consequences of unregistered marriages, because so far even though the community of marriages are not registered but can still make KK, KTP and child birth certificates. There are two problems in the formulation of this research, first, why do the people of Muara Plantau Village still practice marriage under their hands, even though they understand and, second, what is the legal solution to the problem of unregistered marriages. Therefore this research is focused on the community's understanding of marriage registration which the author studies through a descriptive qualitative approach and the type of sociological juridical empirical law or so-called qualitative-field. The results of this study are: (1) The reason people still practice underhand / unregistered marriages is, first: ignorance that the importance of marriage registration because there has never been socialization from the KUA and people who are not registered marriage can still make KK, KTP and Deed birth of second child: there is an assumption from a community that has become a parent, what is important is that it is legal in religion and legally valid is not too important, third: there are married who are underage, fourth: the location of KUA that is difficult to reach, this happens when Barsel not yet divided into two districts, fifth: the feeling of laziness from the prospective bride to take care of the dossier to the KUA. (2) Legal solutions for unregistered marriages; Overall, the six subjects answered to provide legal solutions for those married under the first hand: socialization should be held from the KUA to Muara Plantau Village, if the KUA has not been able to come down directly, it can cooperate with village officials, second: marriage isbat, even if it cannot be done individually , it is expected that the village will make a marriage marriage application letter.
