Abstract

Penelitian ini dilatari banyaknya pemilik bengkel servis motor di kota Palangka Raya mengambil manfaat dari sisa oli bekas. Fokus penelitian ini ini mengapa tidak adanya akad servis ganti oli pada bengkel motor di kota Palangka Raya? dan Bagaimana tinjauan fiqh muamalah terhadap kepemilikan oli bekas pada jasa servis motor di kota Palangka Raya? penelitian ini menggunakan pendekatan Hukum Empiris, dimana yang menjadi subjek penelitian adalah empat pemilik bengkel motor di Kota Palangka Raya. Pengumpulan data dilakukan melalui observasi, wawancara dan dokumentasi.Hasil penelitian bahwa akad servis ganti oli pada bengkel motor di kota Palangka Raya bahwa, dengan harga tersedia atau Include biaya ganti oli. Ini menyatakan bahwa oli bekas adalah milik konsumen, pihak pemilik bengkel tidak ada meminta izin kepada konsumen pemilik oli bekas yang menjadi langganan bengkel karena ketidaktahuan pemilik bengkel motor tentang akad. Mengingat pemilik kendaraan yang telah menggganti oli mesinnya selalu mengabaikan atau ditinggalkan begitu saja sisa oli bekas tersebut di bengkel servis motor, sehingga ungkapan akad atau ucapan untuk meminta oli bekas tersebut tidak pernah dilakukan oleh pemilik bengkel kepada konsumen yang menjadi langganan dalam pergantian oli mesin di bengkelnya. Namun tinjauan fiqh muamalah terhadap kepemilikan oli bekas pada jasa servis motor di kota Palangka Raya, bahwa pada dasarnya pemilik bengkel telah mendapat upah dari jasanya menyervis motor ganti oli pelanggannya, selanjutnya sisa oli bekas yang diambil tanpa izin kepada pemilik motor dalam kajian fikih muamalah, ada beberapa pandangan mazhab yang menyatakan sahnya kepemilikan oli bekas kepada pemilik bengkel motor dalam mengguanakan akad secara t a’athi dan hanya mazhab Shafi’i yang menyatakan kepemilikan oli masih menjadi milik konsumen karna harus dil;akuknya kad secara langsung.

ABSTRACK

This research is motivated by the number of motorbike repair shop owners in the city of Palangka Raya who benefit from the remaining used oil. The focus of this research is why there is no oil change service contract at a motorbike repair shop in Palangka Raya? and How is the fiqh muamalah review of used oil ownership in motorbike service services in the city of Palangka Raya? This study used an Empirical Law approach, where the subjects of the study were four motorbike repair shop owners in Palangka Raya City. Data collection was carried out through observation, interviews and documentation. The results showed that the oil change service contract at a motorbike repair shop in the city of Palangka Raya stated that, with an available price or including the cost of an oil change. This states that used oil is the property of the consumer, the owner of the workshop did not ask permission from consumers who owned used oil who had subscribed to the repair shop because the motorbike repair shop owner did not know the contract. Given that vehicle owners who have changed their engine oil always ignore or just leave the remaining used oil at the motorbike service workshop, so the expression of the contract or speech to ask for used oil is never done by the workshop owner to consumers who are subscribed to changing engine oil in his workshop. . However, fiqh muamalah review of used oil ownership in motorbike service services in the city of Palangka Raya, that basically the workshop owner has received a wage from his service for servicing the motorbike for an oil change to his customer, then the remaining used oil which was taken without permission from the motorbike owner in the muamalah fiqh study, there are several views of the school that state the legal ownership of used oil to the owner of the motorbike repair shop in using the contract regularly. t a'athi and only the Shafi'i school of thought which states that the ownership of oil still belongs to the consumer because it has to be done directly.
