Abstract

Penelitian ini dilatarbelakangi oleh maraknya klaim kerugian pasca akad jual beli motor bekas dengan sistem COD wilayah Palangka Raya. Fokus penelitian ini adalah (1) Bagaimana praktik penyelesaian klaim kerugian pasca akad jual-beli motor bekas dengan sistem cash on delivery di kota Palangka Raya? (2) Bagaimana analisis hukum ekonomi Islam terhadap penyelesaian klaim kerugian pasca akad jual-beli motor bekas dengan sistem cash on delivery di kota Palangka Raya? Subjek penelitian ini adalah penjual dan pembeli motor bekas di forum jual beli motor bekas wiyalah Palangka Raya. Data penelitian dihimpun dengan metode observasi, wawancara dan dokumentasi, dianalisis secara dekriptif kualitatif. Hasil penelitian menunjukkan bahwa proses terjadinya penyelesaian klaim kerugian pasca akad jual beli motor bekas yaitu pembeli menghubungi kembali penjual dilanjutkan pengecekan kecacatan bersama penjual dan pembeli lalu berdiskusi mencari solusi. Dalam praktik penyelesaian klaim kerugian pasca akad jual beli motor bekas penjual dan pembeli akan bermusyawarah untuk mengganti kerugian kecacatan tersebut dengan di bagi dua atau ditanggung secara penuh oleh penjual. Hal ini sejalan dengan konsep musyawarah dan pasal 3 ayat 5 UU Perlindungan Konsumen yang mana menumbuhkan kesadaran pelaku usaha mengenai pentingnya perlindungan konsumen sehingga tumbuh sifat jujur dan bertanggung jawab dalam berusaha. Walaupun belum memenuhi nilai kejujuran akan tetapi penjual melaksanakan prinsip etika hukum amanah, ketuhanan, kenabian, dan tanggungjawab dengan baik, sehingga hak Khiyar yang di klaim oleh pembeli bisa di musyawarahkan dan tidak merugikan kedua belah pihak.

Abstract

This study was motivated by the pervasiveness of loss claims after the contract of purchase and sell of used motors with the COD system of Palangka Raya region. The focus of this research is (1) How is the practice of resolving claims for losses after the agreement of the secondhand motorcycle purchase and sell by using the cash on delivery system in Palangka Raya? (2) How is the analysis of Islamic economic law to resolving claims for losses after the agreement of the secondhand motorcycle purchase and sell by using the cash on delivery system in Palangka Raya? The subjects of this research are sellers and buyers of the secondhand motorcycle in the forum of purchasing and selling in Palangka Raya. The research data were collected by means of observation, interviews and documentation, and analyzed in a descriptive qualitative manner. The results showed that the claims for losses after the secondhand motorcycle purchase and sell was due to the buyer contacts the seller again, then checks for defects with the seller and the buyer, then discusses finding a solution. In the process of claiming losses after the agreement of secondhand motorcycle purchase and sell, the seller and the buyer will discuss to compensate for the defect by dividing it in half or fully borne by the seller. This goes hand in hand with the concept of deliberation and article 3 section 5 of the Consumer Protection Law, which raises an awareness of the importance of consumer protection and thus grows the honest and responsible nature of trying. Even though it has not fulfilled the value of honesty, the seller implements the ethical principles of mandate law, divinity, prophethood, and responsibility properly, so that Khiyar's rights that are claimed by the buyer can be deliberated and do not harm both parties.
