Abstract
Mediasi adalah cara penyelesaian sengketa melalui proses perundingan untuk memperoleh kesepakatan para pihak dengan dibantu oleh mediator. Fokus masalah penelitian ini: (1) Bagaimana praktik mediasi dalam proses perkara perceraian di Pengadilan Agama Palangka Raya?, (2) Bagaimana pandangan hakim mediator terhadap kegagalan mediasi dalam proses perkara perceraian di Pengadilan Agama Palangka Raya?.
Jenis penelitian adalah penelitian hukum empiris dengan pendekatan kualitatif deksriptif dan subjek penelitian adalah lima hakim mediator . sedangkan objek penelitian adalah pandangan hakim mediator terhadap kegagalan mediasi dalam proses perkara perceraian di Pengadilan Agama Palangka Raya. Adapun teknik Pengumpulan data yaitu menggunakan teknik wawancara, observasi dan dokumentasi. Pengabsahan data penelitian ini menggunakan teknik trianggulasi dan dianalisis dengan melalui data collection, data reduction, data display, dan data conclousions drawing/ verifying.
Hasil penelitian ini adalah bahwa praktik mediasi yang dilakukan hakim mediator di Pengadilan Agama Palangka Raya sudah berjalan dengan baik sesuai dengan maṣlaḥah hâjiyah karena menyangkut kebutuhan hidup manusia yang harus dipertahankan untuk mengadakan mediasi. Hakim mediator dalam memediasi memperlakukan para pihak secara sama, oleh sebab itu praktik yang dilaksanakan dapat memberikan manfaat tetapi harus disesuaikan dengan Peraturan Mahkamah Agung. Hakim mediator memandang bahwa kegagalan mediasi dalam proses perkara perceraian di Pengadilan Agama Palangka Raya itu disebabkan karena perceraian merupakan persoalan hati sehingga para pihak bersikeras pada pendiriannya masing-masing tidak ada itikad baik.
ABSTRACT
Mediation is a way of settling disputes through negotiation process to obtain the agreement of the parties with the assistance of a mediator. The focus of this research problem: (1) How does the practice of mediation in the process of a divorce case in Religion Court in Palangka Raya?, (2) What does the mediator judges’ view to the failure of mediation in the process of a divorce case in the Religion Court in Palangka Raya?.
This type of research is empirical legal research with descriptive and qualitative approach research subjects were five judges mediators. whereas the object of research is the view of the failure of mediation mediator judge in the divorce case in the Religion Court in Palangka Raya. Data collection technique is using interview, observation and documentation. Data validation this study using triangulation techniques and analyzed by means of data collection, data reduction, display data, and the data conclousions drawing / verifying.
The results of this study is that the practice of mediation is the mediator in the Religion Court in Palangka Raya already well underway in accordance with maslahah hâjiyah because it involves the necessity of human life that should be retained to conduct the mediation. Judge mediator in mediating treat the parties equally, therefore, the practice implemented to provide benefits but must be adapted to the Rules of the Supreme Court. Judge mediator considers that the failure of mediation in the process of a divorce case in the Religion Court in Palangka Raya it is because divorce is a matter of the heart so that the parties insist on their stance there is no good faith.
